The extremism of Alito

Calling the kettle black in relative terms

The more I read about how "extreme" Judge Samuel Alito is, the more I have to wonder just what is going on with the Democrat party leadership.

Judge Alito would not have been my first choice or my third choice. He probably wouldn't even have made my "Hot 100" list. None the less, it is hard to see him as much more than a moderate conservative. It's very hard to picture him as a "extremist" when Justice Ruth Bader Ginsburg is not. Judge Alito leans heavily towards increasing government power, but that is certainly inline with most of the current Supreme Court.

Except for Justice Clarence Thomas. He would have been an amazing Chief Justice.

There were at least two major cases this last term that would have cemented Democrat's reputation as "protectors of the little guy" if only they would have asked the questions. I would have loved to have seen Judge Alito asked about Kelo v. New London, even if he declined to answer. Or Raich v. Ashcroft. These are basic principles of the Democratic Party stretching back to Thomas Jefferson.

Instead, we hear about abortion and a woman's right to choose.

Again and again and again.

I'll admit that my own feelings about abortion are mixed. I will say that Roe v. Wade is the type of decision that always divides Americans, handed down from on high with no recourse to the democratic process. What's more, it has been treated as an absolute and repeatedly used to stifle dissent and debate.

Considering that most liberals and free thinkers pride themselves on their relative morality, the resort to the absolute carved-in-stone bears-no-discussion unquestioned-wisdom is disconcerting, to say the least. And to constantly make it a cornerstone of the Democratic Party platform even when a sizable portion of Democrat ladies do not support the idea of abortion on demand, well, that shows a sizable disconnect from the voters.

There were some good moments in the hearings. But when Senator Ted Kennedy (of all people) is talking about protecting women's rights, I seriously doubt if anybody except the fringe took it seriously.

I think that these hearings are going to cost the Democrats dearly. I think it made them look foolish and out of the mainstream. If Senator Kerry gets any support for a filibuster, I will be extraordinarily surprised.
